These terms and conditions constitute a legally binding agreement between you (the "User") and ConducIA. By accessing, registering or using any ConducIA service, you agree to be bound by these terms.
ConducIA is NOT affiliated with the Spanish Traffic Authority (DGT).We are an independent educational platform that uses content based on official Spanish regulations.

2. Purpose and Scope of Application
2.1 Purpose of the Contract
These terms regulate the use of the ConducIA digital platform and all services offered through it, including but not limited to:
- Digital educational content: Digital books and educational material updated according to DGT regulations
- Assessment system: Topic-based tests, official exam simulations with over 2,000 dynamic questions
- Tracking tools: Progress system, performance statistics and error analysis
- Gamification: XP points system, streaks, achievements and leaderboards
- Interactive games: Educational mini-games that make learning fun and engaging
- Services for driving schools: Promotional codes, student tracking, performance analysis, management tools and 40% commission program on sales made through their promotional codes
2.2 Target Users
The services are aimed at:
- Individual students: People who want to prepare for the theoretical driving test
- Driving schools: Road training centers that want to integrate digital tools into their methodology
2.3 Age Restrictions
To use ConducIA you must be at least 16 years old. Minors under 18 need express authorization from their parents or legal guardians to create an account and contract paid services.
3. Acceptance of Terms
By registering, accessing or using ConducIA services, you declare and guarantee that:
- You have read, understood and fully accept these terms and conditions
- You meet the age requirements established in the previous section
- You have the necessary legal capacity to enter into binding contracts
- All information provided during registration is truthful, current and complete
- You commit to comply with current Spanish legislation and these terms
- You acknowledge that ConducIA is NOT affiliated with the DGT and is an independent private company

ConducIA offers a comprehensive platform for preparing the theoretical driving test that includes:

Important: Content Origin
ConducIA's questions have been developed entirely by our educational team and, while they follow the format and content established by the DGT and are based on the official curriculum, they are NOT official DGT questions.
ConducIA is an independent private company that provides educational material for driving theory test preparation. Our content is designed to help with preparation, but the official exam will be administered only by the DGT with their own questions.
Artificial Intelligence Technology
ConducIA uses a multimodal artificial intelligence approach that combines models from OpenAI (GPT-5.1) and Anthropic (Claude Sonnet 4.0, 4.5, Opus) for educational question generation.
- AI is used ONLY for initial content generation
- All questions are reviewed and validated by ConducIA's educational team (human oversight)
- NO automated decision-making that affects users is performed
Training sources: The AI models have been trained with official DGT materials that are public and public domain knowledge from the driving field.
4.2 Services for Driving Schools
Driving schools that register with ConducIA can access:
- Promotional codes for their students
- Student progress tracking panel
- Performance statistics and reports
- Academic management tools
- Specialized technical support
- Commission program: Verified driving schools receive 40% commission on all sales made through their promotional codes

Eligibility: Only driving schools that have completed the manual verification process
Conditions: Commissions are calculated on valid sales made by students using promotional codes issued by the driving school
4.3 Important Disclaimer about DGT
IMPORTANT: ConducIA is an independent private company that is NOT affiliated, sponsored, approved or endorsed by the Spanish Traffic Authority (DGT). Our educational content is based on official Spanish regulations, but ConducIA has no official relationship with government agencies.
5. Registration and Account Management
5.1 Registration Process
To access ConducIA services, you must complete the registration process by providing:
- For students: Full name, username, valid email address, secure password, preferred language
- For driving schools: Valid email address, secure password, school name, DGT license number, phone, city, website (optional)
- Acceptance of these terms and conditions
- Acceptance of the privacy policy
- Email verification after registration
5.2 Driving School Verification
Driving schools that register on ConducIA must go through a manual verification process to participate in the commission program:
- Manual validation of DGT license number (no access to official database)
- Confirmation of contact details and location
- Manual review of legitimacy by ConducIA team
- Verification statuses: pending → under review → approved/rejected
- Only verified driving schools can access promotional codes and commission program
- The verification process may take up to 48 business hours
- Commission payments: Made monthly for verified driving schools
5.3 User Responsibilities
The user commits to:
- Provide truthful, accurate, current and complete information
- Keep their profile information updated
- Protect the confidentiality of their access credentials
- Immediately notify any unauthorized use of their account
- Account sharing prohibition: Not share their account, access credentials, or allow the use of their subscription by third parties, including other students, family members or colleagues
- Use the platform only for legitimate educational purposes
5.4 Account Suspension and Cancellation
ConducIA reserves the right to temporarily or permanently suspend any account in case of:
- Violation of these terms and conditions
- Fraudulent or malicious use of the platform
- Non-payment of contracted services
- Activities that harm other users or the platform
- Suspicion of automated activity or bot usage
6. Plans, Pricing and Payment Terms
6.1 Service Modalities
ConducIA offers the following modalities:
1 Month Access - €6.00
Complete access for 1 month to all content: digital books, real simulations, topic tests, gamification and more
2 Months Access - €10.00
Complete access for 2 months - Steady pace, compatible with work/studies, time to improve weak topics
3 Months Access - €12.00
Complete access for 3 months - Maximum flexibility, ideal for learning gradually, extra time to repeat exams

Free registration with management tools for road training centers and 40% commission program
6.2 Pricing and Billing
- Prices are shown in euros (EUR) and include VAT when applicable
- Payments are made in advance according to the selected periodicity (monthly, quarterly, annual)
- Auto-renewal: All subscriptions automatically renew at the end of each period until the user actively cancels the subscription from their account
- Price changes: We reserve the right to adjust our pricing. Any price change will be communicated at least 30 calendar days before the effective date. For subscription services that renew automatically, we will also send reminders of renewal deadlines at least 15 days beforehand, including details on how to cancel
- Startup Pricing Policy: Given ConducIA's initial status as an educational startup, we reserve the right to adjust subscription prices and modify commission rates for driving schools with 30 days advance notice, and introduce new pricing plans according to service evolution. No free trial periods or money-back guarantees are offered
6.3 Promotional Codes
ConducIA may offer promotional codes that:
- Provide discounts on subscription plans
- May be distributed by associated driving schools
- Have specific terms of validity and use
- Are not transferable or cumulative unless otherwise indicated
- May be revoked in case of fraudulent use
6.4 Accepted Payment Methods
Payments are processed through Stripe, ensuring security and PCI DSS compliance:
- Credit and debit cards (Visa, Mastercard, American Express)
- Other payment methods available in Stripe for Spain
- All payments are processed securely using SSL encryption
- We do not store credit card data on our servers
7. Right of Withdrawal and Refunds
7.1 Right of Withdrawal (Consumers)
In accordance with Spanish Royal Legislative Decree 1/2007 (RDL 1/2007), consumer users have the right to withdraw from this contract within 14 calendar days from the date of contracting, without providing any reason.
However, by purchasing a plan and accessing the platform immediately after payment, you:
- Expressly consent to the immediate provision of digital content and services, and
- Acknowledge that you thereby lose your right of withdrawal, as stated in Article 103.m) of RDL 1/2007.
Important: This waiver only applies when immediate access is granted, and you have been clearly informed of this condition prior to purchase.
7.2 Refund Policy
As a result of the exclusion of the right of withdrawal established in the previous section, ConducIA does not process refunds generally. However, refunds will be considered only in the following exceptional cases:
- Serious technical error: Technical failure attributable to ConducIA that completely prevents access to services for more than 7 consecutive days
- Duplicate payments: Processing error resulting in duplicate charges for the same service
- Service cancellation: Unilateral decision by ConducIA to discontinue the service before expiration
Foundation: This policy is based on immediate access to complete digital content, which allows the user to consume all educational material during the 14-day period that would normally be available for exercising the right of withdrawal.
7.3 Money-Back Guarantee for Exam Failure
100% Money-Back Guarantee
If you fail the driving theory exam after studying with ConducIA and meeting the minimum requirements, we will refund 100% of your subscription amount.
Eligibility Requirements:
To request a refund, the user must meet ALL of the following requirements:
- Digital book study: Must have spent at least 1 hour studying each of the 15 topics in the ConducIA digital book
- Topic tests completed: Must have completed all topic tests available on the platform
- Minimum level: Must have reached a minimum level of 60 on the platform (XP and progression system)
- Exam simulations: Must have completed at least 50 exam simulations on the platform
- Proof of failure: Must provide official DGT documentation proving the theory exam failure
- Request deadline: The refund request must be made within one month of the user's last recorded activity on the platform
Request Process:
- Send an email to soporte@conducia.com with the subject "Refund Guarantee Request"
- Attach official DGT documentation proving the exam failure
- Our team will verify compliance with the requirements within 5 business days
- If all requirements are met, the full refund will be processed via the original payment method
Note for driving schools: If a refund is processed for a student who used a driving school's promotional code, the corresponding commission amount will be deducted from that driving school's commission balance.
7.4 Cancellation Process
To cancel your subscription:
- Access your user area on the platform
- Navigate to the "Account Settings" section
- Select "Manage Subscription"
- Confirm cancellation
- You will receive a confirmation email
Cancellation will be effective at the end of the current billing period. You will maintain access to services until that date.
8. Acceptable Use and Restrictions
8.1 Use License
ConducIA grants you a limited, non-exclusive, non-transferable and revocable license to:
- Access and use the platform for personal educational purposes
- Download and view educational content for personal use
- Take tests and exam simulations
- Participate in gamification features
8.2 Prohibited Conduct
It is strictly prohibited to:
- Copy, reproduce, distribute or modify ConducIA content
- Reverse engineer the software or attempt to access source code
- Create multiple or fake accounts
- Use automated tools, bots or scripts
- Share access credentials with third parties
- Interfere with the security or operation of the platform
- Use the service for unauthorized commercial activities
- Infringe intellectual property rights
- Engage in fraudulent or illegal activities
8.3 Consequences of Non-compliance
Non-compliance with these restrictions may result in immediate account suspension, service termination without refund, and legal action where appropriate.
9. Intellectual and Industrial Property
9.1 ConducIA Rights
All elements of the ConducIA platform are protected by intellectual and industrial property rights:
- Platform software and source code
- Design, interface and user experience
- Gamification system and learning algorithms
- Databases and information structures
- "ConducIA" brand and associated graphic elements
- Pedagogical methodology and content organization
9.2 Educational Content Based on Official Sources
ConducIA uses content derived from official Spanish traffic and road safety regulations, including provisions published by the Dirección General de Tráfico (DGT).
While these original regulations are public domain, ConducIA's selection, transformation, contextualization, structuring, and presentation of this material constitutes a protected intellectual creation under Article 10 of the Spanish Intellectual Property Law.
Users acknowledge that the platform's question banks, explanations, study guides, and progression systems are not mere reproductions, but are the result of editorial and instructional effort by ConducIA.
9.3 User Restrictions
Unless expressly authorized in writing, users may not copy, reproduce, redistribute, modify, publish, or create derivative works from any ConducIA content, including visual elements, learning systems, explanations, or study structures.
10. Data Protection and Privacy
10.1 Data Controller
ConducIA acts as data controller in accordance with the General Data Protection Regulation (EU) 2016/679 and Spanish Organic Law 3/2018 on Data Protection.
10.2 Data Processed
ConducIA may process the following categories of data according to user type:
For Students:
- Identifying data: name, email, username
- Contact data: phone number (optional)
- Academic data: educational progress, assessment results, scores
- Usage data: navigation, study time, platform activity
- Gamification data: points, achievements, study streaks
- Communications with customer service
For Driving Schools:
- Identifying data: contact email
- School data: name, DGT license number, phone, website
- Location data: city
- Commercial data: promotional codes, generated commissions
- Usage data: last access, referred student statistics
- Communications with customer service
Common Data:
- Security and account activity logs
- Registration, last update, and email verification dates
Third-Party Services for Data Processing:

- OpenAI/Anthropic: AI model APIs (only for content generation)
Data backups: Automated daily backups via Supabase (30-day retention)
Hosting security: SSL/TLS 1.3 via Vercel with automatic certificate management
Data validation: Both client-side (TypeScript schemas) and server-side validation and sanitization
10.3 User Rights
In accordance with current regulations, you have the right to:

11. Service Availability and Technical Support
11.1 Platform Availability
ConducIA strives to maintain the platform available 24/7, but does not guarantee 100% uptime. Interruptions may occur due to:
- Scheduled maintenance (notified in advance)
- Urgent security updates
- Unforeseen technical failures
- Problems with external service providers
- Force majeure events
11.2 Technical Requirements
To use ConducIA you need:
- Stable internet connection
- Updated web browser (Chrome, Firefox, Safari, Edge)
- JavaScript enabled
- Compatible device (PC, tablet, smartphone)

12. Limitation of Liability
12.1 Nature of Service
IMPORTANT STATEMENT: ConducIA is an educational tool to support studying. Success in the official driving test depends on multiple factors including personal effort, individual capacity, practical experience and other elements outside ConducIA's control. WE DO NOT GUARANTEE specific results or passing the exam.
12.2 Liability Exclusions
ConducIA shall not be liable for any direct or indirect damages, including loss of data, loss of opportunity, or any consequential harm, resulting from:
- Temporary unavailability, errors, or performance issues of the platform
- Interruptions due to maintenance, upgrades, or external service failures
- User-side technical issues, including software/hardware incompatibility or internet failures
- Inaccuracies or typographical errors in the educational content or user interface
- Use of outdated content where official regulations have changed
- Any decisions, actions, or omissions made by the user based solely on the platform's content, without cross-checking with official sources
- Third-party misuse of the platform, including unauthorized account access due to weak or compromised user credentials
- User errors during quizzes, account setup, or exam preparation based on misunderstood content
The platform is provided "as is", and ConducIA does not guarantee that successful use of the platform will result in passing any official driving theory exam. Users are solely responsible for validating their knowledge and complying with DGT requirements.
12.3 Quantitative Limitation
To the maximum extent permitted by applicable law, ConducIA's total liability to the user for any claims arising from the use of the platform shall not exceed the total amount actually paid by the user to ConducIA in the twelve (12) months immediately preceding the event giving rise to the claim.
This limitation does not apply in cases of gross negligence, fraud, or willful misconduct on the part of ConducIA, nor does it affect any non-waivable consumer rights under applicable Spanish or European law.
12.4 Incident Response Procedures
In case of data breach:
- • AEPD notification: Within 72 hours via official electronic portal
- • User notification: If high risk to rights and freedoms exists
- • Containment measures: Immediate isolation of affected systems
- • Documentation: Complete timeline and impact of the breach
13. Service and Terms Modifications
13.1 Service Modifications
ConducIA reserves the right to:
- Add new platform functionality
- Modify or remove existing features
- Update educational content
- Change design and user interface
- Adjust learning and gamification algorithms
13.2 Price Modifications
Price changes will be notified at least 30 days in advance. Users may cancel their subscription before new prices take effect.
13.3 Terms Modification
ConducIA may modify these terms and conditions. Significant changes will be notified by email. Continued use of the platform after notification constitutes acceptance of the new terms.
14. Applicable Law and Jurisdiction
14.1 Applicable Legislation
These Terms and Conditions are governed by the laws of Spain. In particular, the following legal frameworks shall apply:
- Spanish Civil Code – for general contractual obligations
- Royal Legislative Decree 1/2007, of 16 November – on the protection of consumers and users
- Law 34/2002, of 11 July – on Information Society Services and Electronic Commerce (LSSI-CE)
- Organic Law 3/2018, of 5 December – on the Protection of Personal Data and guarantee of digital rights (LOPDGDD)
- Regulation (EU) 2016/679 – General Data Protection Regulation (GDPR)
- Directive (EU) 2019/770, transposed via RDL 1/2007 – on digital content and digital services provided to consumers
14.2 Competent Jurisdiction
For the resolution of any controversy that may arise from the interpretation or execution of these terms, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Madrid, Spain, expressly waiving any other jurisdiction that may correspond to them.
14.3 Alternative Dispute Resolution
ConducIA adheres to alternative dispute resolution systems for consumers. In case of controversy, you may use the EU online dispute resolution platform:https://ec.europa.eu/consumers/odr/

17. Final Provisions
17.1 Partial Validity
If any provision of these terms is declared null or ineffective by a competent authority, the remaining provisions will maintain their full validity and effectiveness.
17.2 Waiver
The non-enforcement by ConducIA of strict compliance with any term or condition shall not constitute a waiver of demanding its compliance in the future.
17.3 Agreement Integrity
These terms and conditions, together with the privacy policy and other referenced documents, constitute the complete agreement between the parties.
17.4 Language
In case of conflict between different language versions of these terms, the Spanish version shall prevail.
